Terms of Service

1. Agreement to Terms

By accessing or using the Savvo AI web application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

"Savvo," "we," "us," and "our" refer to Savvo AI, the company operating the Service. "You" and "your" refer to the individual or entity accessing or using the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Your Account

To use the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if you provide inaccurate information or violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Upload content that you do not have the right to share
• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for any commercial purpose other than your own personal studying (e.g., reselling AI-generated content)
• Use automated scripts, bots, or scrapers to access the Service
• Circumvent any rate limits, usage restrictions, or access controls
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to develop a competing product

5. Your Content

"Your Content" means any materials, text, images, documents, and other content you upload, submit, or create through the Service.

5.1 Ownership

You retain ownership of Your Content. We do not claim ownership over any materials you upload to the Service.

5.2 License to Us

By uploading Your Content, you grant us a limited, non-exclusive, worldwide license to use, process, and store Your Content solely for the purpose of providing and improving the Service. This includes sending Your Content to third-party AI services (such as OpenAI) for processing as described in our Privacy Policy.

5.3 Your Responsibilities

You are solely responsible for Your Content and represent that you have all necessary rights to upload it. You must not upload copyrighted materials unless you have permission from the copyright holder or a valid fair use basis.

5.4 Anonymized & Aggregate Data

We may use anonymized, de-identified, or aggregated data derived from your use of the Service (including usage patterns and learning outcomes) for research, analytics, and product improvement purposes. This data cannot be used to identify you personally and is no longer considered Your Content.

6. AI-Generated Content

The Service uses artificial intelligence to generate study materials including, but not limited to, extracted concepts, practice questions, explanations, study plans, and grading feedback ("AI Content").

• No Guarantee of Accuracy: AI Content may contain errors, inaccuracies, or omissions. It is provided as a study aid, not as a definitive source of truth.
• Not Professional Advice: AI Content does not constitute academic, professional, medical, legal, or any other form of professional advice.
• Your Responsibility: You are responsible for verifying AI Content against authoritative sources. Savvo is not liable for any academic or other consequences resulting from reliance on AI Content.

7. Subscriptions & Payments

7.1 Free & Paid Plans

The Service offers a free tier with limited lifetime usage and a paid subscription ("Pro") with unlimited access. Free tier limits include, but are not limited to: 2 courses, 3 study sets per course, 5 materials, 5 practice sessions, 1 practice test, 3 teach-back sessions, 5 learn sessions, and 20 chat messages. These limits are cumulative (lifetime totals, not per-month). We may adjust free tier limits at any time. Current pricing and full plan details are available on our pricing page.

7.2 Billing

Paid subscriptions are billed in advance on a monthly or yearly basis through Stripe. By subscribing, you authorize us to charge your payment method at the applicable rate.

7.3 Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, your Pro access continues until the end of the current billing period, after which your account reverts to the free tier. We do not provide prorated refunds for partial billing periods.

7.4 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing period after the notice.

8. Intellectual Property

The Service, including its design, code, features, branding, and documentation, is owned by Savvo AI and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy, reliability, or completeness of any AI-generated content.

10. Limitation of Liability

To the maximum extent permitted by law, Savvo AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or academic consequences, arising out of or related to your use of the Service, regardless of the theory of liability.

Our total liability for any claim arising out of or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Savvo AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights (including intellectual property rights).

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. We will generally provide reasonable advance notice before termination, except in cases involving abuse, fraud, legal requirements, or violation of these Terms, where we may act immediately. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive (including ownership, warranty disclaimers, indemnity, and limitations of liability).

You may delete your account at any time. Upon account deletion, your data will be handled as described in our Privacy Policy.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal legal action, you agree to attempt to resolve disputes informally by contacting us through our contact form. We will attempt to resolve the dispute in good faith within 30 days. If the dispute is not resolved informally, either party may proceed with formal resolution as described below.

13.2 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes not resolved informally shall be brought exclusively in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
